1. Acceptance of Terms

By accessing or using IronLand.com you confirm that you have read, understood and agree to be bound by these Terms & Conditions and by our Privacy Policy and Cookie Policy. If you use the site on behalf of a dealership, rental company or other business, you confirm that you have authority to bind that business. If you do not agree, stop using the site.

2. Description of Service

IronLand.com is an online classifieds yard for heavy equipment. Dealers, rental companies and equipment owners post lots for new and used machines - earthmoving, forestry, mining, agriculture, lift and yard, haul and transport, power and air, and attachments - marked for sale, for rent by the week, or both. Visitors browse the board by yard and by deal type and contact the seller. IronLand.com provides the listing board and nothing else: it is not a party to any sale, rental, transport, financing or insurance arrangement, and it takes no title to any machine.

3. Eligibility

The site is a commercial trading yard and is intended for users aged 18 or over who can lawfully enter contracts. Only a person who owns a machine, or who holds written authority from the owner to market it, may post a lot for it.

4. Listing Rules for Sellers

When you post a lot you are publishing a commercial offer and you take responsibility for it. You agree to:

  • State the machine, year, hours or mileage and configuration accurately, and grade its condition honestly - including the faults
  • Use photographs of the actual machine you are offering, not stock or borrowed images
  • Post a real asking price or weekly rate and honour it while the lot is live, or say plainly that the price is negotiable
  • Sell or rent only what you are lawfully entitled to sell or rent, free of undisclosed liens, and disclose known title, lien or rebuild history
  • Never post stolen, counterfeit or illegally imported equipment, or a machine you know to be unsafe to operate
  • Answer enquiries promptly and remove the lot as soon as the machine is sold, rented long-term or no longer available
  • Comply with all laws that apply to you: dealer licensing, hour-meter honesty, emissions and DEF rules, data protection and advertising standards

5. Prohibited Conduct

You shall not: (a) reverse-engineer, decompile or disassemble the application; (b) use bots, scrapers or other automated systems to harvest lot data, prices or seller details without our written permission; (c) interfere with or disrupt the integrity or performance of the platform; (d) impersonate any person or business, or post under another dealership's name; (e) post duplicate, misleading or fictitious lots, or bait prices; (f) arrange payment for goods you never intend to deliver; (g) attempt to access another user's account or data; or (h) reuse our marks, layout or lot copy on a competing board.

6. Fees

Listing a lot on IronLand.com is free and we take no commission or success fee from a sale or a rental. Any charge we may introduce later will be published here before it applies, and only to features you choose to buy. Money for a machine moves directly between the parties - IronLand.com never asks a buyer or renter to pay us.

7. Your Content and Our License

You keep ownership of the text, photographs and specifications you post. By posting, you grant IronLand.com a worldwide, royalty-free, non-exclusive license to display, reproduce and adapt that material for the purpose of operating the yard - showing the ticket, filing it in a category, and citing it to promote the site. You warrant that you hold the rights to grant that license. We may adjust formatting, and we may refuse, demote, hide or remove any lot at our discretion.

8. Intellectual Property

All original content, design, code, graphics and marks on IronLand.com belong to IronLand.com or its licensors and are protected by international copyright, trademark and intellectual-property laws. Manufacturer and model names appear only to identify equipment and belong to their own owners. Full details in our Copyright Notice.

9. Deals Are Between the Parties

You deal with another user at your own risk. Inspect before you pay, verify title and liens in writing, get a signed bill of sale or rental agreement, and use a payment method with the protection you need. IronLand.com does not screen sellers, arbitrate disputes, refund payments, replace a machine or compensate a lost deal. Our Disclaimer applies in full.

10. Warranties and As-Is Sale

The site is provided as-is and as-available. Any warranty on a machine - express, implied, of merchantability, of fitness for a purpose, or any dealer or factory support - comes from the seller who gives it, never from IronLand.com. Unless the written contract between buyer and seller says otherwise, used equipment trades as-is, where-is, with all faults.

11. Limitation of Liability

To the maximum extent permitted by law, IronLand.com shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost machines, lost data or business interruption, arising from your use of the site or from a transaction you conclude with another user. Where liability cannot be excluded, it is limited to the greater of one hundred US dollars and the fees you paid us in the twelve months before the claim.

12. Indemnity

You will defend and hold IronLand.com harmless from claims, losses and reasonable costs - including attorney's fees - arising from the lots you post, the machines you sell or rent, your use of the site, and your breach of these terms or of any law.

13. Suspension and Termination

We may suspend an account, hide a lot or block access where we reasonably believe these terms, the law or the safety of users have been breached, or that a seller's conduct puts buyers at risk. You may stop using the site at any time; on termination your license to use it ends and your live lots may be removed.

14. Changes to These Terms

We may modify these terms. Material changes will be posted on this page with an updated revision date before they take effect. Your continued use of the site afterwards means you accept the revised terms.

15. Governing Law and Severability

These terms are governed by the laws of the jurisdiction from which IronLand.com is operated, without regard to conflict-of-law principles, and they do not exclude rights you cannot lawfully waive. If any provision is held unenforceable, the remainder continues in force.
